1. Basic statement agreements
All agreements the client closes through the internet or other means of distance communication with our GRINTO SHOP, is covered under the General business conditions. When the client places an order he/she explicitly agrees with these conditions.
2. Offer + contract agreement
2.1 The in writing, oral or per e-mail order confirmation from the client are considered offer, to which the client commits himself for the duration of one week. The agreement becomes final through order confirmation or shipment/delivery of the goods within this week.
2.2 Should any delivery delays occur GRINTO SHOP will immediately inform the client, yet no later than one week of this occurrence.
2.3 The offer from GRINTO SHOP is free of obligation and is under the restriction that goods are available in time, subject to an exceptional before hand agreement is made in writing. Non delivery or inability to keep terms of delivery due to partial or complete unavailability of the goods, gives the client the right the cancel the agreement, only after a fruitless outcome after a suitable period of a least a fortnight. The client has no further rights in matters like these.
2.4 Partial deliveries are permitted.
3. The right to return goods.
3.1 When the client is also the user according to § 13 BGB, he/she has the right to return the goods, which were ordered through the internet or other means of distance communication at our GRINTO SHOP, without any reason within a fortnight to a, to him/her, explicitly informed address. This period starts a the earliest at the arrival of the goods. To stay within these guidelines the return shipment should follow immediately.
3.2 All goods need to be returned to GRINTO SHOP as insured package in perfect state including undamaged wrapping materials.
3.3 The client pays the costs for return shipment. The sales price will be reimbursed when goods are returned or exchanged.
ALL RETURN SHIPMENTS MUST BE POSTAGE PAID !!!!!!!
GRINTO SHOP will not except any return shipments that are unpaid and will send them to the return address.
3.4 Within three working days after the receipt of returned goods, GRINTO SHOP will reimburse the sales price. The client needs to forward his/her account number in time, yet within the limit of the return shipment.
3.5 Reimbursement of the whole sales price cannot be claimed, in case the value of the goods is decreased, through use, through damaging of the goods or its wrapping material or through other circumstances, for which the client is accountable. In these cases GRINTO SHOP will deduct a suitable amount of the value. Should the decrease in value of the goods be too substantial, so GRINTO SHOP considers the goods irreplaceable loss or unable to sell, goods will in principle not be accepted.
4. Prices and shipment conditions.
4.1 Prices are to be paid, that are shown on our websites at the time of order. GRINTO SHOP has the right to correct these prices when it is obvious that they were caused by errors.
4.2 All prices are in euros and are inclusive 19% VAT, which is legally required.
4.3 Wrapping- and postage costs, which will have to be paid by the client, will be added to the sales price.
4.4 Shipment of the goods will occur after payment through the account of the client, which the client has given to GRINTO SHOP. It is also possible, after mutual agreement, to collect the goods within a certain term at cash payment.
4.5 Shipment will occur within three days, after the amount is cashed from the client’s account.
4.6 Immediately after the order is placed, GRINTO SHOP will reserve the goods for the client. Should there be no payment within ten days after the order, GRINTO SHOP reserves the right to use the goods for other purposes.
4.7 GRINOT SHOP will send goods without exceptions as insured package.
4.8 Should goods be damaged or lost during transport, GRINTO SHOP will immediately hold the causer accountable and demand compensation. GRINTO SHOP is not obliged to send the client a replacement or reimburse his/her money, for as long the transport damage is conclusively determined or the procedure for compensation is not yet completed.
5. Warrantee
5.1 As per § 437 BGB the client only has, in case delivered goods should be damaged, the right for compensation, i.e. the client has the choice to demand the goods to be replaced or have the damaged goods repaired. Only after two unsuccessful attempts by GRINTO SHOP to replace the goods, the client has further warrantee claims, such as a decrease of the sales price or to cancel the order.
5.2 GRINTO SHOP reserves the right to consider warrantee conditions, after the client has returned the damaged goods to GRINTO SHOP, so GRINTO can determine whether the client’s claim is legitimate. Should it be determined that damage occurred despite careful testing or should it be determined that damage is inflicted by the client, all claims at the warrantee are dismissed. The client will then get his/her goods returned in the same state it was returned to GRINTO SHOP and costs caused by this shipment are to be paid by the client.
5.3 Damage caused by transport can only be acknowledged, when the client immediately, yet no later than 48 hours after receipt of the goods, informs GRINTO SHOP in writing or per e-mail, in which it is essential that the report is send within a term within the conditions.
